The IRS will not tell you if someone claimed him. But----you can file your return that claims him---you just have to file by mail now. The IRS will sort out the duplicate use of his SSN. You cannot e-file this year with his SSN on your return.
When you mail a tax return, you need to attach any documents showing tax withheld, such as your W-2’s or any 1099’s. Use a mailing service that will track it, such as UPS or certified mail so you will know the IRS/state received the return.
Federal and state returns must be in separate envelopes and they are mailed to different addresses. Read the mailing instructions that print with your tax return carefully so you mail them to the right addresses.

The IRS will send you the tax refund that is on your federal tax return.
Within a year the IRS will start an investigation to find out who was eligible to claim the dependent. They will contact you and the other party by mail. The loser of the investigation must pay back any refund received based on the improper claiming of the dependent plus penalties and interest.
Guess I should not have assumed that the e-file was being rejected.
@shellielynn69 Was your e-file that claimed your step-father rejected? Or was something else happening?
