To claim the Head of Household filing status even though you are not claiming your son, make sure you indicate that your son lived with you the whole year or more than six months. Also:

• On the Do you have an agreement with the other parent about who can claim him? screen, check Yes. 
• On the Is the other parent claiming your son per your legal agreement? screen, check Yes. 
• On the Did you pay more than half the cost to keep up your home in 2016? screen, check Yes.
• Continue with the on-screen questions.
