The W-2 was provided by a sales person who returned commissions they should not have charged.

You should answer no to the question "Did the W-2 involve an intent to earn money?" There was not an intent to earn money, just a return of what should not have been charged.

for a refund of your own money you should not get a W-2 nor a 1099-MISC.

Ask the person for a corrected W-2 showing zero.
