I moved to California in August of 2025. Prior to moving, I was employed in Arizona with employer sponsored healthcare. I could not find a job for a couple of months while living in California and had very little savings and could not afford healthcare. I found a job and began employment in October of 2025. However, there was a 3 month waiting period for healthcare coverage which just took effect in January 2026. Can I qualify for a waiver in 2025?

Form FTB 3853 is used to determine if you owe an individual shared responsibility penalty or to claim exemptions from the state individual health coverage mandate on your California state tax return. Thank you. So I utilize only the earnings while living in California as basis for the waiver? Do I need to fill out the waiver first or can I just claim a waiver on my California return?
You can fill out the form in the California tax return if you don't have coverage for 3 consecutive months. If you need a different exemption for other months, such as affordability (because you didn't have income in those months), you would need to request it through the Covered California website.
