Can 2 people living at the same address both claim head of household? What if person # 1 is married with no dependants and person #2 has dependents. Person number 2 is not the spouse of person #1. However, person #1 owns the home but allows the person #2 with children to reside in the home. Person #1 owns the home and pays the majority of the bills but person #2 has dependants and has their own seperate bills.

Neither can claim Head of Household since the first is married and the other doesn’t provide more than half of the upkeep of the home.
If person #1 claims married filing jointly, can person #2 claim head of household if they take care of their dependent even though they do not pay the majority of the bills in the household? Person #2 does pay a car payment and insurance and their own credit cards and is the sole provider of their kids.
#1 can't file Married filing as he/she isn't married.
#2 can't file Head of Household as he/she does not pay more than half of the household expenses.
Both have to file Single. #2 will claim the dependents.
