Hello,
I am an international student in the US who is considered resident alien for tax purposes. My employer is not withholding FICA telling me that because of the total agreement between the US and my country ( Brazil,) I don't need to pay FICA . I have had 2 jobs before this one and both withheld FICA. This is the first time I have an employer saying I don't need to pay FICA. I don't have the certificate that is required for the total agreement and Brazil doesnt tax me for social security. I am very confused because I don't want to end up paying a huge amount of tax because of his mistake. I file taxes as a resident and have been doing so for the last 6 years. If he continues to not withhold FICA, how should I proceed? Do I need to pay out of pocket when I file tax next year?
