I think Turbo tax has aproblem. it keeps reducing my qualified education expense by $10000 for the education credit that i cant take thereby causing me to include part of my 529 distribution to be taxable, which should not be the case

There is no $10,000 education credit. Do you have a scholarship for that amount? A scholarship would reduce expenses. What does your 1098-T have in box 1 and 5? How much is the 529 distribution? Are you an undergraduate student? Are your parents claiming you?

my 1098 does not have anything in box 5 tuition only 13000...no scholarships or loans or financial aid

1099q 12000 withdrawl from 529 va plan

why is turbo tax trying to calculate income on a percentage of the earning in box 2 of the 1099Q of 1400

If you are a dependent and your parents are paying more than 50% of the cost of your living and expenses then they should be claiming you as a dependent. They should also be taking the education credits - even though the 1098 has your name on it - on their tax return.

 

If you are paying for everything in your own world and you are over 19 and not living at home then you should be claiming yourself on your taxes.  You should discuss with your parents changing their return to remove you as a dependent and otherwise you can mail in a tax return that claims yourself and the education credits.

my parents dont qualify for credit income limitation. do i have to claim the 1098 and 1099 because turbo tax is adjusting my tuition exp by $10000 for a credit i cant get and putting some of the earning notated on the 1099q as income???

As @RobertB4444 points out, if you are a dependent, your parents (or whomever supports you) should be claiming you on their return and they could claim an education credit if eligible. 

 

IF YOU ARE ENTERING THE EDUCATION FORMS INTO YOUR TURBOTAX PROGRAM, AND IT IS CALCULATING AN EDUCATION CREDIT, you DID NOT select "Someone else can claim me" and "Someone else will claim me". That is done in the Personal Info Interview.

If you had, the program would not be allocating 10,000 towards a credit. 

 

If the distribution reported on the 1099-Q was used for education purposes, including Room and Board, it needn't be reported nor entered on anyone's return.

 

If the scholarship received in Box 5 on the 1098-T is less the tuition paid in Box 1, the 1098-T would not be entered on anyone's return (unless it could used towards a credit).

 

If Box 5 is larger, you need to subtract the scholarship from your tuition, books and fees expenses, and claim the excess as income. 

 

Since you indicate that your parent's income makes them ineligible for an education credit, you would only enter the amount of scholarship income you need to report as earned income. 

OR

If you have tax liability (without regard to the 1098-T) and there are more education expenses than scholarship and distributions, you do have an option to claim the "Non-refundable" portion of the American Opportunity Tax Credit. The credit could lower your tax due. To take this option, you select "Yes" to "Someone else can claim me" but "No" to "Someone else will claim me" 

In other words, you still file as a dependent, but your parents DO NOT CLAIM YOU on their return. 

 

This allows you to get the non-refundable part of the AOTC, but not the refundable portion. 

 

This is not used often, and if your parents already filed and claimed you, they would need to amend their return and you would need to paper-file.

I did say I am claimed by someone else and that i dont qualify for the education credit but then calculates income from the QTP?? I have no scholarships and took a distribution for less than tuition??

Thank you. Page 52 for qualified distributions at IRS Publication 970, Tax Benefits for EducationIf all of the 529 went to qualified education expenses plus room and board, you can delete the form 1099-Q. It is not reported on anybody's return.

 

Since your parents are claiming you, you don't qualify for the education credit. The limits were increased this year to help more parents qualify. If your parents income is too high, then nobody gets the education credit.

 

Delete the 1099-Q and education expenses for you. Since it was less than tuition, let your parents know there is some tuition money left and here are the new rules: 

The phaseout for  AOTC is:

$80,000-$90,000 or

$160,000- $180,000 MFJ

I noticed the same thing after entering 1099-Q and 1098-T data. This resulted in Turbotax indicating we owed a lot in Federal and state income taxes, even though our tuition, room and board and qualified expenses exceeding the 529 account distribution. Not filling out the 1099-Q misses the point of why TurboTax reduces the qualified education expenses by $10000. Furthermore some of us rely on  TurboTax to review tax calculations for the year and in the case of an audit.

This problem has been going on since at least 2019 (just do a Google Search).  Turbo Tax is NOT SMART enough to know that just because a student that is filing his/her own taxes despite being a dependent, the parent may not qualify for any education tax credit.  It just blindly assume the credit was taken by the parents/guardians.

 

It is taking the lazy way out by just assuming and reducing the educational expenses by $10,000.  I have no idea where the $10,000 comes from as pointed out in a previous reply.

 

To TURBO TAX programmers, I have wasted hours trying to figure what was going on.  All you need to add to you program is a simple question.  Either ask (1) whether or not parents claim the educational credits  OR (2) ask for Parents AGI to automatically determine if there is any credit to be claimed.  if there is a possibility then ask question (1). 

 

The people in the 2019 thread (see below) had to manually change the Line 17 (1st column) in the Student Information Worksheet to $0.00  Read and Decide for Yourself.  Line 17 is the source of all of this grief.
