Dual Status Individual - Calculating the tax return

Hi team,

 

I'm a dual-status individual for this tax year.  I became a resident alien this tax year starting Oct 2024. 

 

Question: how do I calculate my taxes assuming I have 100k income, 80k as NRA and 20k as RA?

 

If I file two forms (1040 + 1040-NR), does that mean I need to split my 100k income into two forms, and then calculate the tax separately?

 

Doesn't that mean my marginal tax rate as a RA (20k, 12%) would be lower than as a NRA (80k, 22%), and that I can claim deductions from both forms?

 

I'm super confused and couldn't find good answers anywhere. Thanks in advance for the answers!

Dual Status Individual - Calculating the tax return

It depends on several factors.  If you use tax preparation software, the software will compute the tax for you automatically.  I don't know what your filing status is but here is a 2024 tax table you may use as a guideline to determine what your tax will be, after deductions.

 

As far as what income to report for both 1040 NR and 1040, you would need to determine how much income was earned prior to Oct 2024 and report that on the 1040 NR form.  You would then determine what income was earned from Oct 2024 until Dec 31 and report on the 1040 return.

 

As far as deductions, you may only itemize deductions on your 1040NR return as you will not be able to claim the standard deduction amount even though it may be higher.  You may claim the standard deduction on your 1040 return.
