Hello, I am an international student living and studying in the state of Minnesota. I started living in this state since Fall 2018. I meet IRS substantial presence test for the tax year 2023. However, when I went to determine my tax residency with the university tax clinics, they determine my federal tax residency as dual-status alien. Again, foreign national information system at the university determines me as tax resident alien with residency changed after 7/2/23. My spouse also started her studies in the same state in January 2021 and she is a non-resident alien.
I am looking for suggestion on how I can go forward to filing my taxes for tax year 2023. Can I still file as resident alien? Can I add my spouse and go for married filing jointly or do I need to file separately? Thank you.
