Does Wife's brother not living in full time but we pay more than 50% of his support and he does not earn more than the allow amount. Why is he not considered a dependent?

You are correct "In-laws" do not have to live with you all year per Publication 501. In the "My Info" section when adding a dependent you are asked what relationship your dependent is. (XXX is my...)

You should select "Brother" from the dropdown menu. If you click on the "I need help choosing" link you see that you select the relationship your in-law has with your spouse.
