It cannot be both. The real issue is whether he CAN be claimed. Either you claim him or he says on his own return that he cannot be claimed.

No, if he does not indicate on his own tax return that he is being claimed as a dependent, then you will not be able to claim him.
Your return would be rejected if you are also claiming him as a dependent and he has already filed his own return.
