My CPA certified accountant failed to file my taxes from 2021. They are telling me that I have to pay the penalties but that they will be refunding me. My question is why do they not write the checks from their firmto cover the penalties, since they still have the tax return (at least I assuming this) ? Has anybody ever heard of a situation like this?

It should not make much of a difference provided you have a written record (signed where necessary) of the events.

Why are you asking TurboTax about your CPA? You should be asking the CPA.
Obviously this has nothing to do with Turbotax software.
As a general business proposition, there is no special reason that blocks the the CPA from writing a check for the penalty, have you write a check for the tax, and put them in the same envelope. Or, you could go to www.irs.gov/payments, and make an electronic payment for the amount of the tax, and they make an electronic payment for the interest and penalties.
However, there is no reason that compels them to pay separately, either. It's part of your business arrangement with them.
