Child Tax Credit Question.

Hello All,

 

I have two kids, one child I claim every year. And the second child I claim every other year with their other parent. The one child that I claim every year, I've received the advanced payments last year. And the other child I didn't because of the year the payments were based off of. In 2020 the other parent claimed the second child. So I didn't receive the advanced payments, but since I am able to claim that child this year I should receive the full tax credit. 

When I attempt to enter that information into turbo tax, the system is not allowing me to enter that situation into the system. Does anyone know how to enter that information into Turbo Tax?

Child Tax Credit Question.

You cannot partial claim a dependent.  You either claim them for the year or you don't.  Even if your ex got the Advanced Payments, you would still get the credit.  The person who claims the child for 2021 is the person who is entitled to the credit.

Sorry I've updated the original post to hopefully clarify my situation a bit better. I have two kids one child I claim every year, and the second is claimed by their other parent every other year. Last year the advanced payments were sent out based on 2020 tax filings. That was the year the other parent claimed the child. This year I can claim that child and I should be able to receive the full tax benefit for the child. 

I am unable to find the option in turbo tax to put this detailed information in (One child I received the advanced payment so I should get the second half of the tax benefit. And the second child I didn't receive any advance payment, so I should receive full tax benefits upon filing my taxes this year.)

Child Tax Credit Question.

You will claim the children like you would normally for 2021.  If you are not the custodial parent then Form 8332, signed by the custodial parent, must accompany your return for the child that is claimed every other year.

 

The fact that the other parent received the advanced child tax credit (ACTC) means that they must report those payments on their tax return.  This could result in an amount that must be repaid to the IRS. The IRS letter 6419 will be issued to that parent so it's important to use this information on their tax return.  Since that parent received the money,  this would mean that parent will have to repay the advance portion they received. The full amount of the credit ($3,000 per child or, if the child is under 6 years of age $3,600) will be claimed on your tax return.

 

Information for the other parent, the one who received the advance follows for you to understand what happens on their return.

 

Fortunately, the IRS is offering repayment protection. This is an income-based program that forgives some or all of what you’d owe. We’ll check for this automatically if you're in this situation.

 

Repayment protection is an income-based program that reduces the amount of excess advance Child Tax Credit payments you have to repay.

Full repayment protection equals $2,000, multiplied by the following:

The number of qualifying children that the IRS took into account when estimating your advance Child Tax Credit payments, minus

The number of qualifying children you’re claiming on your 2021 tax return.

To be eligible for full repayment protection, your adjusted gross income (AGI) for the 2021 tax year must be at or below the following:
