There is no such "marred but filing single" filing status.  If you are legally married and living together you can only file as Married Filing Jointly or Married Filing Separately.

You should be filing as Married Filing Jointly even if one spouse has little or no income.

You can still file as Married Filing Jointly even if your spouse had no income.  Married couples have the option to file jointly or separately on their federal income tax returns. The IRS strongly encourages most couples to file joint tax returns by extending several tax breaks to those who file together. In the vast majority of cases.

Be sure to mark which marital status you want to use in your Personal Info section.

  1. Open your return.
  2. Enter personal information in the Search box.
  3. Click on jump to personal information link.
