Can someone tell me how to make sure this form is attached to my return before I file it and get rejected again F1040-164-01 - Form 8862?

I did the fix my return once and it rejected for same reason. I revisited the eitc section and changed the option that says did irs say you need to attach form F1040-164-01 - Form 8862 but when I downloaded a copy I do t see it there.

The form that should be included in your return is form 8862.  1040-164-01 is the reject code for your return.  So you are fine as long as the 8862 is included.

Here is an article on how to add the 8862 if it is not in your return.
