She may claim your 2 children (her younger siblings) because they meet the rules for a "Qualifying Child" dependent; mainly they lived with her for more than half the year.

She may not claim you because your taxable income is more than $4050, for the whole year.

There are two types of dependents, "Qualifying Children"(QC) and standard ("Qualifying Relative" in IRS parlance even though they don't have to actually be related). There is no income limit for a QC but there is an age limit, a relationship test and residence test. Only a QC qualifies a taxpayer for the Earned Income Credit and the Child Tax Credit. They are interrelated but the rules are different for each.

.A child closely related to a taxpayer can be a “Qualifying Child (QC)” dependent, regardless of the child's income, if:

1.              He is under age 19, or under 24 if a full time student for at least 5 months of the year, or  is totally & permanently disabled

2.              He did not provide more than 1/2 his own support

3.              He lived with the relative (including temporary absences) for more than half the year

4.              He is younger than the relative (not applicable for a disabled child)

5.              If the child meets the rules to be a qualifying child of more than one person, you must be the person entitled to claim the child as a qualifying child (this essentially means that you have the parent’s permission to claim the child, if the child also lived with the parent more than half the year)

6.              If the parents of a child can claim the child as a qualifying child but no parent so claims the child, no one else can claim the child as a qualifying child unless that person's adjusted gross income (AGI) is higher than the highest AGI of any of the child's parents who can claim the child. 

A person can still be a Qualifying relative dependent, if not a Qualifying Child, if he meets the 6 tests for claiming a dependent:

1. Closely Related OR live with the taxpayer ALL year

2. His/her gross taxable income for the year must be less than $4,050 (2016-17)

3. The taxpayer must have provided more than 1/2 his support

In either case:

4. He must be a US citizen or resident of the US, Canada or Mexico

5. He must not file a joint return with his spouse or be claiming a dependent of his own

6. He must not be the qualifying child of another taxpayer

Is your income more than $4,050? Is your daughter an adult?

So you have three kids? Is your daughter the oldest over the age of 18, and the two other kids are minors?

4200 while living head of household in another state, 981 while living with her, and yes she is an adult

sweetie, she lives with her boyfriend and their 2 kids. i lost my housing and due to illness moved in with her.

just curious how this would work, because i plan on filing taxes for self employed income of 4200 while head of household in another state, since may i have been staying with her & her family with my 2 small children, started a business with income at 981. if i file my own taxes, i get back a refund....but she wants our ss# and info to put us on her taxes as dependents because i have not paid housing costs while living with her.

You cannot claim head of Household unless you are claiming at least one dependent. You are also not HoH because you lived in somebody else's home for more than half the year. But you do not need to claim HoH, as you income tax will be zero whether you use HoH or single status. You will owe some self employment tax (social security and medicare); about $730.

Either you or your daughter my claim your kids. Under the rules, the are the qualifying children of both of you. You may choose who will claim them or you can each claim one. But you cannot both claim the same child. Since you are allowed a choice, you should do test returns to see which way  the family comes out best. If you cannot agree on who will claim them; you, as parent, have first choice. The fact that you have not paid housing costs while living with her, is not relevant to the IRS.
Reminder: your daughter cannot claim you. You do not qualify as her dependent.
