You can file your tax return as Married Filing Jointly in the year of the spouse's passing. When entering their personal information in the My Info section, indicate that they passed away during the year and the date of passing.

I e-filed my Deceased brothers 2023 taxes and included the date died. I used his DL on the e-file. I was never prompted to sign or upload any documents. Is this right?
