Yes you can e-file them at the same time, regardless of whether you are getting a federal refund. However, many state forms are not yet ready, so click Review to see if your forms are ready. And....the state cannot be accepted until the IRS accepts your federal return. The IRS starts accepting returns on January 23.

....but...if you are talking about paying for your software preparation fees .....then you must have a Fed refund that is at least ~$40/$45 greater than the actual software preparation fees.

Many of us recommend that you always pay software fees with a credit card.
