Can I claim itemized house deduction if I am on the Deed but not on the mortgage? 50/50 house ownership with the ex-boyfriend, pay 50/50 mortgage.

My ex boyfriend and I bought a house together, he is on the mortgage, I am not But we both are on the Deed of Trust. We pay the mortgage 50/50. I send money to his bank and he pays teh mortgage directly. Can we both claim the deduction?Or only he can?

Only he can.

According to the IRS, to qualify to be able to claim mortgage interest, you need to:
  1. Own the home
  2. Be liable to pay the mortgage, and
  3. Make the payments (He makes the payments.)
