Only one of the non married parents living together can claim the child on their tax return. The child of the other parent should not be listed on their tax return at all. The two parents can decide between them who should claim the child. You may want to determine who gets the biggest tax benefit from claiming the child. This assumes the child meets the requirements to be claimed by either of the parents.

Only one of the non married parents living together can claim the child on their tax return. The child of the other parent should not be listed on their tax return at all. The two parents can decide between them who should claim the child. You may want to determine who gets the biggest tax benefit from claiming the child. This assumes the child meets the requirements to be claimed by either of the parents.

Thank you, I assumed that was the case and was confused why I was getting EIC when my fiancée already claimed them as a dependent and received EIC.  I will removed them completely from my return.  Thanks again

"claimed them as a dependent"? If you are both the parents of more than one child, each of you can claim one child. There may not be any tax benefit from doing that.
