Can a non married gay couple file together since we are buying a home?

If you are not legally married you cannot file as Married on a tax return.  
If you are both on the mortgage and both pay the mortgage payments you can each report your share of the mortgage interest paid on your separate tax returns.  The same with the property taxes paid.  You each can deduct the actual amount you each paid individually.
