Brother accidentally claimed me as dependent and now I can't file my return, what should I do?

For last year's return my brother (rightfully) claimed me as his dependant, but this year I don't know what got into him and he filed his return without changing his saved information from last year; now, I tried to file my own return and it got rejected because I already got claimed as a dependant, even though I no longer qualify as one. What should I do?

He will need to file an amended return and remove you as a dependent.  You will likely need to file an extension pending his getting that done while you wait.  My .02... but ask a real tax advisor!

i think the easiest route to fixing this is to have your brother immediately file an amended return in which he removes you as a dependent and you file for an extension until Oct15. As a follow-up, you should together write a letter to the IRS explaining the error and ask if they will help expedite the correction and possibly waive any penalties you might incur for filing late. I would also either call the IRS and chat with them about the issue and explain what you are doing to rectify it,  and tell them you are planning to file your return as soon as your brother's amended return is filed and accepted.
