Because of a death my husband didn't receive his W2 from 2022 until 12/19/23. I filed an extension & already paid what we owed at the time. What do I do now?

It was my mom & step-dad's business. He passed. My mom has Alzheimer & my brother is living with her. It's been a mess. He just got guardianship & we just got to the 2022 taxes for everyone. I just want to file with this last W2 before we get more penalties. Can someone please tell me what to do now. I filed threw turbortax for years now

Assuming that you are inquiring about filing your husband's tax return -

 

You need to file the 2022 tax return.  You can report the amount of taxes paid with the extension on the 2022 tax return.  If your spouse passed away in 2022 then you can file the 2022 return as Married Filing Jointly.

When entering your spouse's personal information in the Personal Info section of the TurboTax desktop edition you will be asked if your spouse passed away.  Answer Yes and then enter the date of passing.

 

To complete and file a 2022 tax return using TurboTax you would need to purchase, download and install on a personal computer one of the 2022 desktop editions from this website - https://turbotax.intuit.com/personal-taxes/past-years-products/

 

A 2022 tax return can only be printed and mailed, it cannot be e-filed using TurboTax.

 

To enter, change or delete a payment made with an extension request (Federal, State, Local) -

Click on Federal Taxes (Personal using Home and Business)
Click on Deductions and Credits
Click on I'll choose what I work on (if shown)
Scroll down to Estimates and Other Taxes Paid
On Income Taxes Paid, click on the start or update button


On the next screen select the type of extension payment made and click on the start or update button

To file a 2022 return now, you will need to buy the desktop version on a CD or as a download to install on your own Mac or PC.   You can buy directly from Turbotax, or some third party retailers like Amazon, Staples or Best Buy may still have copies of 2022 for sale (don't get confused and buy the 2023 version).  The Deluxe version covers all situation, but for a self-employed business, the Home & Business version has a more supportive interview process.

 

Once installed, you can use the program to prepare as many returns as you like.  Each return is a different document, like having multiple spread sheets or word processor files on your hard drive.  E-filing 2022 returns is closed, so each return will have to be printed and mailed.  Pay attention to the printed instruction page, because it will tell you what address to use and what documents need to be attached.  You should probably use a mailing service with tracking.

 

It sounds like you need to prepare your own joint return (yourself plus your spouse) and maybe a return for your mom and dad.  Your parents will file a joint return this year, even though your father passed during 2023.  However, if your mother is no longer mentally competent, you can't sign her return unless you have a power of attorney that she signed while she was still competent, or you go to court to be declared her guardian.  Note that if you do have a power of attorney, the IRS still wants you to use their form, Form 2848.

If your mother is competent now, but might not be for long, she should sign a form 2848 for you giving you future authorization to deal with her taxes.

 

Lastly, a penalty is only owed if you owe taxes; if you are due a refund, there is no penalty for filing late.  If Turbotax tries to asses a penalty, you should decline, and wait for the IRS to bill you.  At that point, you can request a waiver of the penalty for just cause.

Your post is kind of confusing--no doubt as a result of the tough time you have been having.   But it is unclear who died.  Do you mean your step-father passed away---and he was the owner of the business that your spouse worked for---and your spouse who worked for that business is finally receiving his 2022 W-2?   Or did your spouse pass away?     

 

If you requested an extension and paid your estimated tax due by the filing deadline in April, then make sure that you indicate how much you paid when you file your tax return.

 

When you requested your extension you were supposed to pay your estimated tax due.  Did you enter the payment you made into your tax return?  Go to Federal>Deductions and Credits>Estimates and Other Taxes Paid>Other Income Taxes 

 

As others have explained to you, you cannot use online TurboTax for a 2022 return now.  You have to use the CD/download on a full PC or Mac;  your 2022 return has to be filed by mail.

 

 

When you mail a tax return, you need to attach any documents showing tax withheld, such as your W-2’s or any 1099’s.  Use a mailing service that will track it, such as UPS or certified mail so you will know the IRS/state received the return.

 

 

Federal and state returns must be in separate envelopes and they are mailed to different addresses.  Read the mailing instructions that print with your tax return carefully so you mail them to the right addresses.
