I owe back child support.My husband and I claimed married joint and we claimed 2 dependents whom  are my kids our taxes .I do not work.What portion will be his

$10k sounds high for a refund. Are you sure that is correct?

That gets tricky, especially if you are in a community property state. 

( Community property states:  AZ, CA, ID, LA, NV, NM, TX, WA, WI)

But your spouse could file as "injured spouse" to protect part of the refund.
