How to file or amend your 2017 Minnesota tax return using the TurboTax CD/Download software - to account for retroactive tax provisions enacted December 2019 and March 2020

On December 20, 2019, the Taxpayer Certainty and Disaster Tax Relief Act of 2019 (TCDTR provisions), was enacted into federal law. This retroactively extended primarily business-related items which had previously expired on December 31, 2017. Common items that were extended were the Indian employment credit, railroad track maintenance credit, mine rescue team training credit, Empowerment Zone tax incentives, American Samoa economic development credit, and incentives for energy production, efficiency, and green economy jobs among other provisions.

On March 27, 2020, the Coronavirus Aid, Relief, and Economic Security (CARES) Act was enacted into law. Among other things, this retroactively allowed net operating loss carryback and suspended the 80% loss limitation. Also it retroactively extended the eligibility for federal bonus depreciation to qualified leasehold improvement property, qualified restaurant property, and qualified retail improvement property effective with property placed in service after December 31, 2017.

Because Minnesota has not yet adopted the TCDTR or CARES provisions, you'll need to add or update the info in your return as instructed below, if any of the above-mentioned provisions apply to you.

  1. Select Forms in the upper right.
  2. Then select Open Form in the upper left.
  3. Locate and select the form you want to work on.

How to file an Original (not amended) individual income tax return for Minnesota for tax year 2017 to reflect changes from the TCDTR and/or CARES provisions:

TurboTax Desktop/ProSeries

Note: The federal TurboTax program has not been updated to reflect any of these changes, so if you are filing a Minnesota return that will include these changes, you must calculate the federal taxable income using the Internal Revenue Code (IRC) as amended through 12/31/2018 (2018 IRC), and then separately calculate the federal taxable income with the TCDTR and/or CARES changes (2019 IRC). See more details in the individual items below.

Schedule M1NC, line 4 – report the difference between the federal taxable income calculated per the 2018 IRC and that calculated per the 2019 IRC. The TCDTR and/or CARES changes may also be reported on lines 8b & 10b of Minnesota Schedules KPI or KS or lines 8b and 16b of Minnesota Schedule KF.

Schedule KPI lines 8b & 10b – if you have amounts on these 2 lines, net them out and include on line 4 of Schedule M1NC. Include a net positive amount as a positive number and a net negative amount as a negative number.

Schedule KS lines 8b & 10b – if you have amounts on these 2 lines, net them out and include on line 4 of Schedule M1NC. Include a net positive amount as a positive number and a net negative amount as a negative number.

Schedule KF lines 8b & 16b – if you have amounts on these 2 lines, net them out and include on line 4 of Schedule M1NC. Include a net positive amount as a positive number and a net negative amount as a negative number.

Schedule M1NR lines 10a & 10b – if you are a part-year or nonresident of Minnesota, report the total amount of TCDTR and/or CARES adjustments on line 10a and the Minnesota portion on line 10b.

Filing instructions: Print and file your return, attaching schedules KF, KPI and/or KS as applicable.

How to file an Amended individual income tax return for Minnesota for tax year 2017 to reflect changes from the TCDTR and/or CARES provisions

Schedule M1X – write “TCDTR” or "CARES" in red at the top.

Schedule M1NC, line 4 – report the difference between the federal taxable income calculated per the 2018 IRC and that calculated per the 2019 IRC. The TCDTR and/or CARES changes may also be reported on lines 8b & 10b of Minnesota Schedules KPI or KS or lines 8b and 16b of Minnesota Schedule KF.
