can my wife get state tax exemption if she worked and paid taxes in Kansas but I am stationed in Kansas for military orders but my home of record on my LES is Texas

Yes, Your wife can choose to share state of legal residence with you, even if she never lived there. Texas has no state tax so that is a smart move. Kansas will not tax her wages if she is there because of you.

KS Military benefits state: Kansas Income Tax Exemption for Nonresident Military Spouses: A nonresident Service member’s Spouse may be exempt from paying Kansas taxes on income earned while stationed in Kansas.

 

She can file a nonresident return and claim a refund of employee wages state tax withheld. This doesn't apply to gambling, rental property, etc. She may want to change her k-4 at work to stop withholding.

 

If you need extra time, filing an extension by April 15, 2026, moves your submission deadline to October 15. But remember any taxes owed are still due in full by the original April 15 date.  Pay through either Direct Pay or your individual online account. See if you need to file a state extension.
