**Tax year 2017 and Earlier** Can I deduct attorney's fees from a suit when my ex-husband tried to suspend alimony??

You can deduct legal expenses that are:

  • Related to either doing or keeping your job, such as those you paid to defend yourself against criminal charges arising out of your trade or business,
  • For tax advice related to a divorce if the bill specifies how much is for tax advice and it is determined in a reasonable way, or
  • To collect taxable alimony.

If the attorney fees are not for one of the purposes, the legal fees are not deductible.

You can deduct these type of expenses, as long as you itemize deductions. They will be included as miscellaneous deductions and the deduction will be limited by 2% of your adjusted gross income. Therefore, you will get a deduction for the amount of expenses that exceed 2% of your adjusted gross income.
