Should my unemploment payments be included when figuring my EIC eligibility? The IRS website specificlly says unemploment payments are not EARNED income.

Yes.  Although Unemployment Payments are not considered "earned" income, they, along with any other income included in your Adjusted Gross Income (AGI) on Line 7 of your Form 1040 also factor into the calculation of the EIC.
