Health Insurance

In 2018, I paid for a family medical insurance plan and requested that my spouse, our dependent, and I be on the plan. Unfortunately, in early 2019 I learned that our dependent and I were on the plan but my spouse was not.  Now we are required to pay a $1500 penalty because he did not have medical insurance in 2018. May I declare this situation as a hardship to avoid paying the $1500 penalty?
