Possibly.  In order for your boyfriend to claim your 3 kids for the Other Dependent Credit the following would need to apply:

  • They lived with him for the entire year.  If you have joint custody with their other parent, and they do not live with your boyfriend for 365 days a year, he cannot claim them. 
  • He provided more than half of their support
  • They cannot be a qualifying child of another taxpayer.  This means if you work and you must file a return, he cannot claim them.  

If all of the above apply and they otherwise qualify as dependents, then yes, he may claim them for the $500 Other Dependent Credit.  He would not be eligible to claim Head of Household by claiming them nor would he be eligible to claim the Earned Income Credit or Child Tax Credit since they are not related to him.
