My husband is sole provider for family, but my brother is disabled on SS and has lived with us since Dec 2016. Is he a dependent?

It is possible.  He may be able to be claimed as a qualifying relative if all of the following apply.

  • They are not a qualifying child of another taxpayer
  • Earned less than $4,050 in taxable income  Social Security is generally not included in this calculation.
  • Did not provide his own support
  • You and your husband provided more than half of his support
  • He lived with you for the entire year

If all of the above apply, then he would be eligible to be claimed as a dependent on your tax return.
