My boyfriend makes more but I pay our daughter's expenses, should I claim her?

I live with my boyfriend and we had a daughter last year. He makes more but I pay our daughter's expenses and she is on my health insurance, should I claim her? We don't really care who claims her but I want her to stay on my health insurance. So my other question, if he claims her, can she stay on my health insurance?

assuming your boyfriend and you live together with the child, then your boyfriend is the one that must claim if his adjusted gross income is higher than yours.  insurance coverage is a question that you must ask the insurance company

If you and the other parent live together, either one of you (but not both) may claim the child. You may decide between you which one will claim the child. Only if you can’t agree, does the higher income rule  apply, to see who has first choice. It may be worthwhile to prepare trial returns, both ways,  to see which way the family comes out best.
