Months adult child lived with me: May I include the time spent at a court mandated rehabilitation home or jail if I paid for attorney fees, etc.?

Adult child spent...

4 months at live in Rehabilitation home (court mandated)

1 month at a hospital (spread across 6 months)

4 months in jail

3 months with me

Which may I count as Months Lived with Me?

Your adult child does not have to live with you to be a qualified relative to claim as a dependent.  It is determined by whether he earned $4050 or more in 2016.  If he earned less than that enter him in Personal Info as a Qualified Relative.

Thank you for the information.   I'll look into that section of the regs. to ensure as a Qualified Relative I'll be able to file as Head of Household (meeting any other requirements for HOH).

However, you have to have provided more than 50% of hus support for the entire year.
