Filing MFS to reduce the amount of APTC we must repay. Form 8958 asks "Are allocated community property amts reported on this return?" What does that mean? Thank you!

Also--Do we have to split all our income (we live in a community property state)--or can we just put his income under his 8958 column on his return, and my income in my 8958 column on my return?  Again, thanks so much!

If you live in a community property state, you are required to split 50-50 all items that fall under the definition of community property in your state.  This can be complicated because even the different community property states define community property differently.  The community property worksheets in TurboTax will assist you with this.

Going specifically to your questions:

  • Are allocated community property amounts reported on this return?  The answer is yes provided the worksheets are allocating community property on your return.
  • Do we have to split all our income...or just put his income on one column and mine on the other?  It depends, but probably needs to be split evenly.  It will be split 50/50 if the income is considered community property (it is considered community property if you both are working in the same community property state).  However, you will always need to double-check your state's specific treatment of what is community property.
