Sorry---casualty losses are not deductible on your federal tax return.   Hope  you and the other driver had insurance.

so neither the OP or you had insurance? That makes it a legal issue. This is an income tax forum. Legal advice outside of taxes is not provided. as @xmasbaby0 said "no deduction".
