No. Only the parent that actually claimed the child qualifies.
Who is claiming the child for 2021? Are you claiming him or is the dad claiming him?
If you did NOT claim the child and did NOT get the advance payments in 2021 then you do not say that you received them. That would create a mismatch in the system that will delay your refund for months.
The dad will get a letter 6419 from the IRS that must be entered on his tax return.
If dad claims the child for 2021 then dad gets the other half of the CTC with his refund.
If you claim the child yourself, dad might have to pay back the CTC, but you can get the full amount.
Provide us with some details. Who is claiming the child for 2021? Do you all live together? Or are you divorced/never married and living apart?
No, if you are claiming him this year and you didn't get any of the advanced payments, then you would enter $0.
I'll be claiming my child this year and live separately. I don't want him to have to pay back whatever he got from the advance payments as to that will cause allot of issues. We live separately.
If your child's dad received the advance child tax credit and you claim your child in 2021, you will receive the Child Tax credit. You should say on your tax return that you did not receive the advance child tax credit and you will receive the full tax credit.
As for your child's dad, he should have received form 6419 from the IRS and has to report the amount received on his tax return. Whether he will have to repay the advance depends on whether his adjusted gross income qualifies him for repayment protection.
