I refinanced my Home November 22nd of 2016, I did not have a payment due in December and the new Mortgage went into effect on 1 Jan 2017, which loan will I use for taxes

Well you will get a 1098 from the old mortgage company to use on the 2016 tax return. You may have some interest paid on the refi paperwork and the new mortgage may send a 1098 for that interest.
