I realized I cant have my HSA. I have marked the box stating I do not have a HDHP. When asked if I am withdrawing the money do I check yes or no?

Select Yes if you intend to remove (or already have removed) the excess from your HSA by contacting the HSA custodian and requesting a "return of excess contribution" (not a regular distribution).  Answer No if you intend to leave the excess in the HSA and pay penalties every year that the excess remains in the account.  (I suggest answering Yes and obtaining a return of excess contribution rather than paying penalties year after year.)
