I had to travel out of state for a non compete lawsuit with a former employer and had to pay for the travel cost for both myself and my attorney is this tax deductible?

The suit was brought against me to keep me out of my chosen industry and it was settled in arbitration in another state. This was only a employment issue

Yes and you may also include your legal fees. 

They are Miscellaneous Deductions, which must exceed 2% of your AGI before you will notice a deduction on your tax return.
