I do not have an HSA. I have an HRA and a FSA. It will not let me file electronically because it needs the 5329 -T form

I have tried deleting the form multiple times and it will not remove it from my return.

First, please check the 5320 (if you can) and see which lines have dollar amounts. The 5329 reports on quite a number of situations, of which HSA excess contribution penalties are just one. The following process will work only if you don;t have any other penalties on the 5329.

 

Now let's assume that the dollar amounts are only on line 42-49 in Part VII. This is the section for HSA penalties.

 

It sounds like you need to get rid of all HSA data. The most direct was to do this is as follows:

 

1. make a copy of your W-2(s) (if you don't have the paper copies)

2. delete your W-2(s) (use the garbage can icon next to the W-2(s) on the Income screen

 

*** Desktop***

3. go to View (at the top), choose Forms, and select the desired form. Note the Delete Form button at the bottom of the screen.

 

*** Online ***

3. go to Tax Tools (on the left), and navigate to Tools->Delete a form

 

4. delete form(s) 1099-SA (if one), 8889-T, and 8889-S (if one), and form 5329-T and -S (if one)

5. go back and re-add your W-2(s), preferably adding them manually

6. continue with your return.

 

NOTE: if you see a question "What type of High Deductible Health Plan did you have any December 1, 2018?" (yes, 2018), be sure to answer "NONE".

One other thing to check ... does  your W-2 have an amount in Box 12 with code "W"?

If the taxpayer has an HRA and an FSA, he/she is highly unlikely to have a code W in box 12, because that indicates that the employer is contributing to (or passing payroll deductions to) an HSA, and an employer who provides an HRA is not likely to make that mistake (although in tax, all things are possible).

 

But the chance of a code W in box 12 is the reason that step #2 deletes the W-2s and step #5 adds them back...if after doing this, the 8889 comes back, then we would take the next step and ask about (1) the code W, and (2) a QFD from an IRA to the HSA (also quite rare, so I don't mention it on the first pass).

 

The instructions above fix 99.9% of HSA problems (when the taxpayer has accidentally indicated that he/she had an HSA and wants to get rid of it).

 

Perhaps the taxpayer will come back and tell us how it went.
