I divorced last year, do we split the Federal and State tax refund/payment that we received/paid?
The federal tax refund is not taxable. However, if you and your ex-husband itemized your deductions in 2015, the state income tax refund would be includible in your 2016 income. If that is the case and you divorced in 2016, you would split your total state tax refund and each report 50% of the total on each of your 2016 single status tax returns.
If you paid 2016 federal or state taxes in the form of a quarterly estimated tax payments, tax payments with extensions, 2015 refunds applied to your 2016 taxes, or any other federal/state taxes that were paid in 2016, they would also be split and are deductible on your 2016 tax returns.
