I claimed a donor advised fund as a cash charitable contribution instead of non-cash charitable contribution and did not file form 8283. Do i need to file amended return?

I don't know that this will affect my overall tax but I now realize I made a mistake.  I have already filed and gotten my refund.

I claimed a donor advised fund as a cash charitable contribution instead of non-cash charitable contribution and did not file form 8283. Do i need to file amended return?

You should file an amended form and just add the 8283.  Although the tax will not change, the IRS will disallow the deduction, and then you would owe tax for the re-calculated amount.

 

Failure To File Form 8283

Your deduction generally will be disallowed if you fail to:

  • Attach a required Form 8283 to your return,

  • Get a required appraisal and complete Section B of Form 8283, or

  • Attach to your return a required appraisal of clothing or household items not in good used condition, an easement on a building in a registered historic district, or property for which you claimed a deduction of more than $500,000.

Your deduction will not be disallowed if your failure was due to reasonable cause and not willful neglect or was due to a good-faith omission.
