a flex spending account is usually part of an IRS section125 cafeteria plan maintained by your employer. you get the tax benefit because taxable wages box 1 of your w-2 is supposed to be reduced by your contributions taken out of your paycheck and put into the account. for further questions about this talk to your employer's payroll department.

If the flex plan is a Section 125 plan, then if the plan is a Health FSA (Flexible Spending Account) , there are no reporting requirements for the FSA. See the note on page 16 of Pub 969.
