How do I file my taxes if I was exempt for 7 months and resident for tax purposes for 5 months in 2024

Hi,

I entered the US in Aug 2019 on an F-1 visa.

I was a non-resident for tax purposes till July 2024, but for the rest of the year (5 months), I would be considered a resident.

All my forms & taxes held are for non-resident case for the entire year.

How do I file my taxes for this year & what software would best suit me?

@Query3 , based on your post:

(a) You entered with F-1  in 2019 ( August/Sept ).  Thus ,and assuming no contravening facts,  you would have been on exempt status till 12/31/2023.  So you started counting days present ( for SPT) from 01/01/2024.  This would mean that for 2024 you were a resident for tax purposes ---  see -->

Residency starting date under the substantial presence test

If you meet the substantial presence test for a calendar year, your residency starting date is generally the first day you are present in the United States during that calendar year.

 

This is from  -- Residency starting and ending dates | Internal Revenue Service

 

Thus you are a Resident  for Tax purposes for the whole of 2024.

I am still on F-1 STEM extension. Thus all the institutes still give me all tax docs based on that status.

How can I file tax with those 1042 docs on turbo tax or any of the US resident tax software?

@Query3  as I pointed out you a resident for the whole year  ( see my ref  for residency start date ).

Thus you use  Standard deduction  and form 1040 ( supported  by TurboTax.

Which country are you from -- some countries  have specific non-taxability of  student/trainee income.

On 1042-S , you have two options -- either the employer rescinds the 1042-S and issues you a W-2  ( a bit unlikely , especially if they have already issued/transmitted to the IRS )   OR

map the 1042-S boxes to W-2 entry in to the TurboTax.
