Form 8936-Can mother apply for tax credit if BOTH (Son & Mom) are owners and are filing individually. Son is NOT a dependent of the mother.

Form 8936-Can mother apply for tax credit if BOTH (Son & Mom) are owners and are filing individually. Son is NOT a dependent of the mother. Son applied for the California rebates BUT doesn't have federal tax liability because of other tax credits.

 

It's my understanding is that since both are on the tiltle either of them can claim the elctric car tax credit by filling out the Form 8936. Please confirm my understanding or help me understand on how to file for the $ 3,750 tax credit for 2019.

Checking the IRS instructions for Form 8936, there is no guidance for what to do when there are multiple owners listed for the vehicle.  It only states that you must own the vehicle to claim the credit.  

 

As long as the credit is claimed by only one owner, there should be no issue.
