Child’s father claimed child without my permission

My children’s father claimed my kids on his income tax without my (the custodial parents) permission. Can I still claim my children? Will I get in to trouble for also claiming my children when they lived with me for the majority of the year without seeing or having support from him?

Child’s father claimed child without my permission

If his tax return is accepted by the IRS and yours is rejected then you will have to print and mail your tax return.  Do not make any changes to your return.  If you are owed a tax refund the IRS will pay the refund.  The IRS will investigate the tax returns and contact each party by mail to find out who was eligible to claim the child's personal exemption.  The loser of the investigation gets to pay back any tax refund along with penalties and interest.
