The distribution must be from a plan maintained by the employer from which the taxpayer retired as a public safety officer. 

Also, the distribution must be made directly from the plan to the provider of the accident or health plan or long-term care insurance contract.

I meet all the qualifications for a maximum deduction of $3000 yet it does not appear in the total on line 5 - Where should I add it and will this conflict with the amount shown on the 1099R// Thanks

If you meet the qualifications when you answer the questions in TurboTax you will receive the deduction.  The amount for Box 5 are Employee Contributions and has nothing to do with the $3,000 deduction for Insurance being paid for by the plan administrator.

Thanks for the reply but I tried to explain it better in a new post this morning - I thought that the deduction (up to $3000) had to be indicated on the 1099r to be valid. Correct me Please.Thanks

From this point, there are two things you can do.  If Health insurance premiums were deducted from your distributions and if you have proof of it:

  1. Report the amount in Box 5. in the meantime,ask the plan administrator to issue you a corrected 1099R showing that amount in Box 5. Turbo will ask you a series of questions based on this entry.
  2. if they refuse, be sure to keep all of your documentation proving that insurance premiums were indeed deducted from the distributions.  Keep that proof as part of your tax return in case if you were questioned by IRS about the discrepancy.  Make sure you mention to them (if you are questioned by IRS) that the administrator refused to issue a corrected 1099R.
  3. This all contingent on the fact you are a retired public safety officer.

Thank you - I have my annual statements and all one has to do is add up the medical which is actually shown in box 5 and add up the dental premium which is on my annual statement both are taken from my monthly payout. The problem I have is they (the Govt.} issuing the 1099r never adds the dental and because it amounts only to about a 13% extra refund on the amount paid I usually don't bother with it. It is just a pain for the few $$$ that I would receive and not worth the trouble if I could actually get it. OPM never gets it right, maybe one day they will. Thanks Again
