Yes, you are an MO resident the entire year based on your statement "all of 2021, assuming that property you paid rent for was your primary residence as would be indicated by things such as the address on your driver's license, where you're registered to vote, and a fair number of other things.
Thank you. I should mention, the rental residence in MO has been "temporary" until our home is built in KS, so we did not change the address on our driver's licenses. And my husband's W-2 lists the building/new property address in KS, and my W-2 lists the MO address. My husband's employer is based in MO, but they sent us a W-2 for both MO and KS (we're assuming KS because he gave them the address of the new property in July). Based on his actual work location and us residing in MO the entire year, we think we should really only file in MO. BUT, he received two W-2's...one for MO and one for KS, so we don't want to not report to KS.
Each state has their own residency criteria. So you may want to check that. There's a simplified chart at https://dor.mo.gov/pdf/nonres_flowchart.pdf.
Thank you for your assistance!
