Worked in NY only for a few days, then moved and worked WA for most of 2020 (for the same company). W2 issued by the company allocated ALL my income to NY state. Do I need to pay NY tax for all my income?

Is this a W2 mistake that I need to talk to my HR about? Usually Box 16 (State wages, tips, etc) only shows the amount that should be allowcated to that state. But now it shows ALL my income.

 

Since WA doesn't have state income tax, does this mean I have to pay NY for all my income? even tho I was only there for a few days in 2020.

Not necessarily- New York requires New York employers to report total wages paid to employees if they worked in side and outside New York.  Some employers will list in Box 14 NY Wages for the actual wages reportable to New York. If it is not, you will have to allocate the New York wages.

 

NOTE: New York does tax remote workers if the company is in New York and the work you do is not required to be done remotely (Google "Convenience of the Employer") so you may be required to pay New York nonresident taxes.

TurboTax allows you to split your income in the New York section and only report your NY earnings.

  • Go to the New York section of TurboTax
  • Keep going until you reach New York Income Allocation
  • Say NO to Were all of your wages and/or your self-employment income earned in New York State?
  • On Your Form W-2 Summary, Edit your employer
  • Allocate your wages to New York by days worked in New York state or percentage of income (which is usually easier.
