The Colorado Senior Housing Income Tax Credit is missing from TurboTax this year, but it still exists and I qualify for it. Is there a way to report this issue?

It does exist so let's look at some possibilities.

  1. Perhaps the CO Social Security income exclusion  not functioning properly is causing trouble. If you receive Social Security, you will want to sign up to be notified when that issue is corrected.
  2. Verify your property tax has no senior exemption and your income is low enough.

 Income Qualified Senior Housing Income Tax Credit | CO DOR 

“Colorado seniors 65 years of age or older may qualify for the Income Qualified Senior Housing Income Tax Credit. Please read below carefully to determine if you qualify for the credit, and to calculate how much you qualify for. 

  1. Is your date of birth (or your spouse's date of birth) December 31, 1960 or earlier?
    • Yes: Continue to step 2. 
    • No: Stop, you do not qualify for this credit.
  2. Were you (or was your spouse) a full-year or part-year resident of Colorado?
    • Yes: Continue to step 3.
    • No: Stop, you do not qualify for this credit. 
  3. Is your adjusted gross income (line 11 of your federal tax form 1040, 1040-SR, or 1040-NR) for this income tax year $75,000 / MFJ $125,000 or less?
    • Yes: Continue to step 4.
    • No: Stop, you do not qualify for this credit. 
  4. Did you receive a partial property tax exemption for your primary residence under section 39-3-204 of the Colorado Revised Statutes (commonly known as the Senior Property Tax Exemption, Senior Homestead Exemption or Disabled Veteran Exemption) for the property tax year? The exemption should appear on your property tax statement from your county assessor. You may have been approved for the exemption by applying in a prior year. This exemption is generally allowed if one owner of a home is 65 years old as of January 1, and has occupied the home as a primary residence for at least 10 consecutive years.
    • No: You qualify for this income tax credit. Continue to step 5 in order to calculate the amount of credit you are eligible to receive. 
    • Yes: Stop, you do not qualify for this credit. 

The program will look up your federal filing status and adjusted gross income (AGI) in the Senior Housing Income Tax Credit table and select the corresponding credit value.
 

There is always the possibility of technical issues but I feel your problem lies with one or both of the above issues. I did see where this has been reported in the past and determined not to be an error.

I qualify under all steps 1-5, however Turbo Tax does not show form 104 CH in my "Go to Forms". There is not a prompt box to check for Senior Housing Credit. How do I enter my qualifying information?

This is a TurboTax error. I am helping my father file his taxes, which I have been doing through TurboTax for many years. He has always qualified for this credit. Nothing changed with his income. I read the tax law already. It is not complicated. There was an option to claim this last year and it's completely missing this year. I wonder how many seniors have been shorted on this credit because they used TurboTax this year. I have tried to report this numerous different ways and your response is the only one I've received. Are you going to do anything to fix this error?

I've tried to report this so many different ways and so far all I got is the response above from their "tax expert" which completely disregards the possibility this is a TurboTax error. There are so many credits listed you can check your eligibility for. My dad is not eligible for any of them. And then this one is just completely missing. Obviously a TurboTax error. So far, they don't seem that interested in fixing it. I wonder if they do fix it if they will reach back out to all the people who have been impacted and not received this credit because they used TurboTax.

I'm also having this problem. In 2024, the housing credit showed up just fine. I recorded a negative AGI of ($10,722) and that pulled through onto the state return as the "federal income" number.

 

For 2025, I'm also recording a negative AGI of ($21,574) based on netting the standard deduction, less income, i.e., the Standard Deduction is higher than the Total Income.  The taxpayer qualifies for the CO Housing Credit, but it is not showing on the list of CO  credits and taxes. Turbotax should not be masking this option.

 

The link below about the Social Security Income Exclusion is no longer working, so I assume the problem has been fixed and that is not the issue.

Colorado General Assembly SB25-013 Senior Housing Income Tax Credit Extension would have extended the tax credit for "income tax years commencing on January 2, 2025 and January 1, 2026". Unfortunately, it lost the vote so there is no longer a credit.

I found out this tax credit expired. 2024 was the last year. There was legislation put forward to extend it, but it was not passed. Talked to a state rep about it. They basically said the because of the deficit, the state can't afford fully refundable credits like this one so they let them expire. You can chatgpt it and it will give you a pretty thorough and correct explanation, at least it did for me.
